If I go bankrupt because of students loans, will I lose my car that I am making payments on?

default-avatar
Answered by attorney John F Brennan (Unclaimed Profile)
Bankruptcy lawyer at Musilli Brennan Associates, PLLC
Generally student loans are not dischargable and therefore bankruptcy will probably offer you little relief. There is a hardship exception on the student loans but it is difficult to qualify for. For you own good see a competent bankruptcy attorney before you do anything and possibly make a grave mistake.

I just went through a divorce when can I file a chapter 7?

Answered by attorney Myron Wayne Tucker (Unclaimed Profile)
Bankruptcy lawyer at Orrock, Popka, Tucker Dolen
You can file a Chapter 7 at any time. You will need to prepare and file a means test to determine if the presumption of abuse arises. Assuming it does not, you could proceed with a Chapter 7.

Can only one spouse file if both share the income? How?

default-avatar
Answered by attorney Dorothy G. Bunce (Unclaimed Profile)
Bankruptcy lawyer at A Fresh Start
It is not necessary for your spouse to file bankruptcy with you, but I am not entirely sure that was what you wanted to know. There can be some major repercussions to the spouse that does not file bankruptcy but a full review of your situation would be necessary to say for sure.
