What can we do if my husband’s 82 y. o. mother has run up more bills on her credit cards than she can cover the minimum payments on?

Answered by attorney Roger J Bus (Unclaimed Profile)

She (in my view) should consider filing a Chapter 7 bankruptcy, have her credit card debt discharged. I know that may be hard for her to accept, but that probably is the best option at this point.

Will my house go in foreclosure if I convert from a chapter 13 to 7?

Diane L Drain
Answered by attorney Diane L Drain (Unclaimed Profile)
Bankruptcy lawyer at Law Office of D. L. Drain, P.A.
The trustee did not send a letter of dismissal for just missing one payment. Talk to your bankruptcy attorney to determine the problem. As to your question about the house and converting the case. You are fine so long as you are not behind on any payments to any lender secured on the house.

When do property liens expire?

Answered by attorney Dorothy G. Bunce (Unclaimed Profile)
Bankruptcy lawyer at A Fresh Start
It depends on the type of lien and the type of property. A judgment lien will expire in 7 years, unless renewed. A voluntary lien, like a mortgage, deed of trust, or car loan may never expire. Most liens can be renewed before they expire, and so can technically, like a Vampire, live forever.
