Can I inherit property while in a chapter 13 bankruptcy?

Answered by attorney Sharon M. Siegel
Bankruptcy lawyer at Siegel & Siegel, P.C.
This is a very complex matter, which intersects bankruptcy and estates law. In general, the information you got is wrong. Post petition assets in a Ch. 13 can be claimed by the trustee. The house is not yours, but your share may be. You need to take very specific actions in the trust and the bankruptcy. Do not discuss this matter with the trustee of your trust or your bankruptcy until you have spoken to a lawyer. Too much information to the wrong person will cost you. I have just finished a case just like yours, and the matter needs to be handled very carefully to preserve as much assets as possible.

Will chapter 7 discharge the debts including the title loan and allow us to keep our vehicle as it's our primary vehicle?

default-avatar
Answered by attorney Dorothy G. Bunce (Unclaimed Profile)
Bankruptcy lawyer at A Fresh Start
A chapter 7 will discharge a title loan, but the vehicle will continue to owe the debt. As a result, if you don?t pay the title loan, the lender will be able to repo the vehicle once the bankruptcy stay comes to an end. Chapter 7 generally does not change the nature of liens, and a title loan is a lien. Unless a redemption will provide you with a better deal by refinancing the vehicle at FMV, it sounds like Chapter 7 will not achieve your objective. Other options might also be available to help you, but more information would be needed, along with competent representation.
