Will bankruptcy take care of IRS and state EDD taxes 10 years back?

default-avatar
Answered by attorney Dorothy G. Bunce (Unclaimed Profile)
Bankruptcy lawyer at A Fresh Start
It is possible that a bankruptcy could discharge an IRS debt as well as a debt for state unemployment taxes, but honestly, it is impossible to guarantee you a particular result without more information. For example, was a tax lien filed? Why were the taxes owed? When were the taxes filed? That is why you need to have legal representation.

What happens if a debtor sells their home without the court's approval?

Diane L Drain
Answered by attorney Diane L Drain (Unclaimed Profile)
Bankruptcy lawyer at Law Office of D. L. Drain, P.A.
You cannot sell or buy valuable assets without at least approval from the chapter 13 trustee and the court. You need to work with your attorney. If you do not have an attorney you need to get one. In Arizona, debtors who do not have attorneys have less than 2% of chance that their chapter 13 will be successful.

If we did not reaffirm on mortgage after filing Chapter 7 Bankruptcy, can we walk away from the mortgage? How?

Answered by attorney Marjorie A. Guymon
Bankruptcy lawyer at Goldsmith & Guymon, P.C.
If you did not reaffirm the mortgage in your bankruptcy you were discharged of your obligation to pay. All you need to quit making payments. You can either attempt a short sale, deed in lieu, or allow the bank to foreclose. The payment will not be reported to the credit bureau because you did not reaffirm the debt.
