That is correct. If you did not reaffirm the debt secured by your house, you can walk away (and the bank cannot call a default and try to evict you as long as you are current on your house). This often leads the banks holding the note against a house not to report the monthly payments you are making it seems to be a strategy to force you to reaffirm, but Courts have ruled that they are not wrong in not reporting the payments.

It depends. 11 U.S.C. 523(a)(6) does not discharge debts incurred through willful and malicious injury to another or another's property. 11 U.S.C. 523(a)(9) does not discharge debts incurred for death or personal injury caused by operation of a motor vehicle if unlawful because of intoxication. Also, most restitution is nondischargeable.

It means a mess. I just received 2 bankruptcy notices from lenders in my clients' cases. I am trying to figure out what that means with respect to a stay of proceedings, objections to claims, and the like. If you are just making payments and have no problems with the lender, it probably means nothing. Just make a written record of payments, etc. Keep copies of everything that you send.
