Elder Law – With advancing age and retirement comes the necessity of utilizing different planning techniques and strategies within the realm of estate planning, Medicaid & Veterans benefits planning, asset protection, long term care and advance directives to provide for the financial, medical, personal care and legal needs of our clients and their families.

Estate Planning – The lawyers of our firm draft wills and trusts to provide for the disposition of assets in accordance with our clients wishes while minimizing tax consequences, maximizing access to available benefits, protecting assets, providing for special needs of family members and avoiding or reducing the time and expense of estate administration. Power of Attorneys, Health Care Proxies and Living Wills are an important part of a proper estate plan.

Medicaid Planning & Benefits – Qualifying for Medicaid benefits for long term care, whether at home or in a nursing home, often times becomes a paramount concern for our clients. Our lawyers implement Medicaid advance planning and crisis planning strategies to qualify clients for Medicaid benefits and assist in the application process.

Probate & Estate Administration – Our estate administration services include representing fiduciaries and heirs in probate proceedings (when there is a will) and administration proceedings (when there is no will). Preparation and review of necessary Surrogate Court filings, accountings and tax filings are part of these services.

Estate Litigation – When a family member feels their rights have been infringed upon, or they are otherwise denied what they are entitled to after a loved one has passed, estate litigation sometimes become inevitable. We represent our clients in will contests, challenges to lifetime transfers and changes in beneficiary selections, claims of capacity and undue influence, accountings, spousal elective share, trust administration and various other disputes that may arise in the context of an estate.

Guardianships – For elders who can no longer manage their medical or financial affairs we advise on and participate in guardianship proceedings.

Veterans Benefits – We assist Veterans and their families obtain the benefits they are entitled to.
