The Two Paths to Divorce in Florida

Regular Dissolution of Marriage—The first step in this path to divorce is for either spouse to petition for a dissolution of marriage either in the county the couple last lived together or where one spouse currently resides. This petition states that the marriage is irrevocably damaged and begins the divorce timeline. The other spouse has 20 days to respond after they have been served with the petition. Next, both parties will have to submit financial documents and, if applicable, a child support guidelines worksheet.

Simplified Dissolution of Marriage—In a simplified dissolution of marriage, financial documents can be requested but they are not required. This can speed up the divorce proceeding, but only some couples will qualify for a simplified dissolution of marriage. To qualify, the couple must meet all of the following requirements:

• Both parties agree to the use of this form of dissolution and agree the marriage is irrevocably damaged;

• The couple has no dependant children;

• The couple has no adopted children under the age of 18;

• There is no pregnancy;

• At least one spouse has lived in Florida for the past six months;

• The couple has agreed upon the split of assets and debts; and

• Neither spouse is planning on seeking alimony.

When Does A Divorce Become Contested?

When both parties in the marriage cannot come to an agreement on issues surrounding the divorce, the divorce becomes contested. This means that the case will go to a hearing before a judge, who will rule on the issues that are being disagreed on. Reasons a divorce may become contested include when the spouses cannot reach an agreement on how to split assets, how to split marital property, how to manage debts, alimony payments, child support, and child custody. An experienced divorce attorney will understand how to negotiate on your behalf to avoid a contested divorce where the decisions end up being left in the hands of a judge.

What Is the Difference Between a Contested Divorce & Uncontested Divorce?

When divorcing spouses agree on divorce-related issues, the divorce is referred to as an “uncontested” divorce. If divorcing spouses cannot reach an agreement on some or all divorce-related issues, the divorce is referred to as a “contested” divorce. Simply because you start the divorce process arguing with your spouse doesn’t mean you won’t be able to achieve a satisfactory divorce agreement before the divorce process is over.
