Sloane Anders Wildman is a shareholder in the Environmental Group of Babst Calland. Ms. Wildman’s practice involves CERCLA and RCRA site remediation and counseling clients in all aspects of environmental law and regulation, including RCRA, CERCLA/EPCRA release reporting, Safe Drinking Water Act, TSCA, FIFRA, green marketing, the Clean Water Act and the Clean Air Act. She represents clients in administrative, civil judicial and criminal enforcement cases. Her wide-ranging RCRA experience includes counseling, defense of enforcement actions and permitting and encompasses all aspects of federal and state hazardous waste regulation, including solid and hazardous waste identification, generation, transportation, treatment, storage, disposal, closure and corrective action matters.

Ms. Wildman also has significant experience managing environmental due diligence reviews and risk allocation issues in support of various types of transactions, including acquisitions, sales and refinancings, and has represented lenders in environmental matters associated with loan workouts and foreclosures. Prior to joining Babst Calland,

Ms. Wildman was a partner in a large international law firm focusing on environmental and natural resources law.

Representative Matters

• Advised specialty chemical manufacturer regarding a wide range of environmental regulations, including, in particular, RCRA requirements for waste identification, wastewater treatment unit exemption, delisting, land disposal restrictions, recycling and financial assurance obligations. Defended company in U.S. Environmental Protection Agency, Washington State Department of Ecology and Washington State Pollution Control Hearings Board proceedings, in litigation against biosolids recycler and related insurance recovery action.

• Defended Alaska oil exploration company in civil and criminal claims under RCRA, CERCLA/EPCRA release reporting, and Safe Drinking Water Act/UIC enforcement action on North Slope of Alaska related to alleged improper disposal of drilling fluids, including negotiating with U.S. Department of Justice environmental crimes and civil enforcement attorneys and U.S. EPA Region 10.

• Provided RCRA representation and counseling to coalition of western water utilities.

• Represented chemical manufacturer in RCRA permit renewal proceedings with Washington State Department of Ecology and U.S. EPA Region 10, including negotiations over scope of RCRA corrective action requirements, applicability of RCRA’s contained-in policy and sale of facility.

• Advised oil company on Clean Water Act jurisdictional issues associated with tundra on the North Slope of Alaska.

• Defended Oregon bulk storage company in government investigation into alleged Ocean Dumping Act and Clean Water Act violations.

• Represented oil companies in RCRA corrective action remediation of railroad properties in Alaska.

• Advised cruise ship company regarding applicability of Clean Water Act, MARPOL and other international treaties to cruise ship dischargers.

• Represented aircraft manufacturer in various site remediation matters in Washington and California.

• Represented former owner of Michigan paper mill in settlement of CERCLA and Natural Resource Damages claims.

• Represented numerous private equity and other clients in environmental due diligence and other environmental matters associated with acquisition, sale, investment and financing transactions, including commissioning and review of Phase 1 and Phase 2 environmental site assessments, negotiating transactions, transferring facility permits, and managing environmental risk.

• Represented special servicers in environmental matters associated with loan workouts and foreclosures.

• Counseled national retailer regarding toxics in packaging, pesticide registration and other regulatory issues. Defended company in state and federal regulatory enforcement matters.

• Counseled secondary aluminum manufacturing facility regarding Clean Water Act and Clean Air Act compliance and PCB/TSCA remediation issues and defended company in government Clean Water Act investigation regarding release of PCBs from wastewater treatment system.

Background

Ms. Wildman earned her B.A., cum laude, from Dartmouth College. She received her J.D. from the University of Virginia School of Law, where she was the Notes Editor for the Virginia Tax Review.

Memberships and Affiliations

Ms. Wildman is admitted to practice in the District of Columbia and California (inactive) and before the U.S. District Courts for the Eastern and Southern Districts of California. She is a member of the District of Columbia Bar Association’s Environment, Energy and Natural Resources Section and the American Bar Association.
