Hired Attorney

A person elected or appointed assistant county attorney shall qualify by taking the prescribed oath as provided in Iowa Rule 63.10 and give bond as provided in Iowa Rule 64.8. Subscribe the persons signature on the written certificate of appointment which shall be kept in the office of the auditor as provided in Iowa Rule 331.903. As Assistant Benton County Attorney Derek Marsh has knowledge that Alisha Stach falsely claimed to be and assumed to act (for 107 days), as if Stach was First Assistant Benton County Attorney and knowing that Stach had no authority to act in the capacity of a prosecuting attorney. Marsh has failed inform the appropriate professional authority. Thus Marsh has violated Iowa Rule 32:8.3. REPORTING PROFESSIONAL MISCONDUCT. In fact Derek Marsh defends Stach lack of duty to uphold the iowa Constitution; which is professional misconduct. Further Marsh has knowledge that Stach violated a Code of Professional Responsibility and has engaged in willful misconduct.
