I spoke with Mr. Tim Houchin of Brune Law Firm on Tuesday, January 5. We discussed a breach of contract issue. During the conversation, I mentioned that I had read hearsay is inadmissible in court, to which Mr. Houchin replied hearsay IS admissible in small claims court because the rules of evidence are much more lax. Mr. Houchin told me I could use estimates, receipts, and written statements as evidence in small claims court. Unfortunately, hearsay is not admissible in small claims court. I lost my court case because of Mr. Houchin’s grossly erroneous legal advice. A local attorney should be familiar with the court's procedures and requirements for evidence and should counsel potential clients and clients appropriately. Mr. Houchin’s negligence destroyed my case and cost me thousands of dollars.
