Representative Cases & TransactionsCasesRepresentative Matters: Represented a subcontractor against a $5 million claim arising from alleged deficiencies with the subcontractor's work in the installation of mechanical systems for companion apartment buildings. The $5 million was actually money paid by the claimant. After the client's substantial settlement offer was rejected, the court ruled on the client's motion for summary judgment
granted the motion, relieving our client of monetary responsibility.
Defended a general contractor in a multi-million dollar construction defect litigation where the plaintiff claimed that all of the windows in her luxury custom home had to be removed
replaced because they were all leaking or prone to leak. Though the client was the only party with a direct contractual relationship with the plaintiff, the client's portion of the substantial sum needed to settle the case was less than 20% of the total settlement amount as we were able to demonstrate that the client's subcontractors were principally responsible for the faulty installation.
Settled a product defect claim on the eve of trial for a fraction of the million dollar dem
originally made by the plaintiff property owners. The client was a major manufacturer of polyethylene (PEX) piping
the plaintiffs were alleging that the client's piping leaked
also leached hazardous chemicals into their drinking water. The favorable settlement was achieved after we successfully refuted plaintiffs' experts' theories that there was a system-wide failure of the piping
that the piping was contaminating the drinking water.
Quickly settled a serious traumatic brain injury case with limited discovery. The plaintiff alleged that our client, a bar/restaurant owner, failed to provide adequate security in the bar when the plaintiff was hit
knocked to the ground by another bar customer. The brain injury was so serious that plaintiff underwent an induced coma
was hospitalized for more than a month.
Tried four easement disputes to judgment over the last five years in four different Northern California counties, with successful outcomes.
