Americans with Disabilities Act (“ADA”) Title III Counseling and Defense
• Representation of public accommodations in preventive counseling and defense of ADA Title III architectural barrier, website, mobile application, and auxiliary aid actions.
• Analysis and resolution of pre-litigation demand letters, EOV’s and pre-litigation claim notices, preventing litigation.
• Collaboration with a network of engineers, architects, and ADA professionals to review public accommodations, including websites and physical properties, to implement strategies to identify and reduce the risk of access litigation.
• Developing policies, procedures, and best practices to address ADA compliance for use in due diligence during acquisition of a public accommodation, risk management and litigation avoidance, operations and building maintenance, managing obligations between commercial landlords and tenants, construction and remodeling, and on-site training, seminars, webinars, and presentations addressing clients’ industry/property specific accessibility concerns.
Representation of Commercial and Residential Landlords
• A responsive resource for commercial, residential, and multi-family housing property managers and owners with questions regarding daily operational issues, tenants, lease terms, eviction, regulations, and statutory compliance.
• Lease and addendum negotiation, preparation, and review.
• Termination of commercial and residential leases, including eviction of tenants in default.
• Actions in ejectment for unauthorized occupants.
• Working with owners and management of multi-family housing to establish and implement internal procedures and policies to minimize financial risks and promote FHA and statutory compliance.
• Arbitration, mediation, and trial of claims before minor and trial courts regarding tenant default, eviction, and possession.
• Defense of property owners and management personnel with respect to claims asserted by tenants and third parties in both civil and criminal courts and, local, state, and federal administrative agencies including Housing and Urban Development, the Pennsylvania Human Relations Commission, the Public Utility Commission, City and County health department and building code enforcement.
• Attendance at grievance conferences for owners of public housing.
