In order to prove a medical malpractice case, a claimant must prove a failure to conform to accepted practice, resulting in an injury. Expert testimony from a physician is required. These cases are difficult and expensive to prove and they do not settle out of court. Absent catastrophic injuries, it does not make financial sense to go forward even if malpractice was committed

The limit on the medical expenses is-$15,000 - has to do with the driver?s insurance. That just means $15,000 is all the insurance will cover. If you have additional bills, you can sue the driver, and she will have to pay the bills if the Court orders her to. If you settle the case, you can?t get more money regardless if you have additional medical bills. Have a conversation with your attorney.

Proper notice is to be personally served with a copy of the Summons to Court and Petition seeking damages from you. Proper notice can also be leaving those documents with any family member at your residence who is at least 16 years old. If you believe you were improperly served, you should consult a lawyer to enter a limited appearance for the sole purpose of objecting to service. There are other rules that apply to Service of Summons (also called Service of Process). You should consult with an experienced attorney to be adequately advised about your rights.
