What is the law of limitations on personal injury when the victim never filed a charge because he had no insurance?

In New York, the statute of limitations is three years, but under the circumstances you describe there could be problems of proof even if suit is filed timely.

What steps can I take after being mistreated after surgery, from mediation to a catheter mishap to release before ready?

Answered by attorney Steven A. Schwartz
Personal Injury lawyer at Joel H. Schwartz, P.C.
What you are looking to do is make a medical malpractice claim, but from the information you provided, I do not think it makes practical sense to do so at this time. Malpractice claims are VERY expensive, requiring numerous depositions and the hiring of medical experts. I think you will find that the majority of malpractice attorneys will only take a malpractice claim if the damages are severe and permanent. It sounds like there may be some malpractice here, but it does not sound like the malpractice caused severe and permanent injury. Unfortunately, I think you will spend more money prosecuting this case than you stand to gain.

What can I do if I am being sued over a dog bite?

default-avatar
Answered by attorney Kevin Marc Habberfield (Unclaimed Profile)
Personal Injury lawyer at Black, Lyle & Habberfield, LLP
For starters, get insurance. You really need it, especially if you are inviting the public into your place of business. It's simply crazy not to have a CGL policy. Now, since you do not have insurance, there is no one to turn the claim over to. So you will be negotiating with the attorney directly. Lucky for you, it doesn't sound like the guy is hurt too badly so the claim is worth very little if anything. Wait to see what sort of demand they make. If warranted, get an attorney. If not, maybe you kick them a few bucks to make them go away. Either way, keep that dog away from people so this doesn't happen in the future but, that doesn't mean you have to take him out of the store. I love dogs and like seeing them in businesses, just be careful.
