I don't practice in the area of labor law, but I don't think the hospital would have a legal basis for firing you....but it sure wouldn't help your career to do so.

The issue is whether the standard of care for emergency medicine required the doctor to order a CT scan. If not, you will probably not be able to win a case. The other issue is whether the delay in diagnosing your cancer will make a significant difference in your prognosis. I don't know the answer to either question. If this happened in Wisconsin, you have three years in which to file a request for mediation with the Medical Mediation Panels or to file a lawsuit.
