The statute of limitation in New York to bring a legal action for a personal injury claim is 3 years from the date of occurance. Therefore, if the even happen in 2011 than you still in the good shape. However, you may want to contact my office for further consulation to determine whether you may have a claim of liability. Can I sue

Answered by attorney Lori Nevias
Personal Injury lawyer at Lori Nevias, Attorney at Law
You can sue the murderer, but it is unlikely that you can successfully sue the club. The murder took place in your car, which is not club property. Even if it was parked in the parking lot of the business, unless you can prove that the former employee had a criminal history and the club owner knew or should have known of the employee's propensity for violence, the club will not be held responsible.

Unless you have evidence to prove that there was some sort of corruption going on, you cannot take any action. Investigators have "qualified immunity" meaning that they can't be held liable for mistakes made in the course of investigation, as long as those mistakes were in "good faith", not intended to harm you.
