Is the homeowner liable for my injury if I was injured while helping him move items?

Thomas C. Bulman
Answered by attorney Thomas C. Bulman (Unclaimed Profile)
Personal Injury lawyer at Bulman Law Associates PLLC
Probably not. You need to prove that something the homeowner did was careless and caused your injury. Doesn't sound likely with a bicep tear. However, the HO may have medical payments coverage in his policy that pays medical expenses without having to prove liability. Usually limited to 1K to 10K if it is a good company.

If worker’s compensation physician places you on permanent light duty with restrictions, can I just settle?

Laura Maria Lanzisera
Answered by attorney Laura Maria Lanzisera (Unclaimed Profile)
Personal Injury lawyer at The Law Offices of Laura M. Lanzisera
Yes, you can settle if the insurance company is interested (settlement is voluntary on both sides).? The value of your case will depend upon many factors: 1) is your employer accommodating your restrictions, 2) how much medical treatment do you need, 3) what is your weekly benefit rate, 4) and what is your permanent partial disability rating. I would highly suggest that you contact a workers' compensation lawyer. Although the lawyer will receive 25% of your settlement amount, the value he/she can achieve in settlement amount should be much higher.

What happens if I dont sign for the medical claims release form?

Joseph Isaac Lipsky
Answered by attorney Joseph Isaac Lipsky (Unclaimed Profile)

The question of whether to provide an insurance company access to your son's medical records, for purposes of ascertaining the severity of the personal injuries he sustained from the car accident, is one you should certainly discuss with an experienced personal injury attorney.
