You can sue the person who intentionally or negligently caused your son's death. In Virginia, wrongful death cases can be brought within two (2) years of the incident unless there is a statute to the contrary.

Well, you would have been entitled to Worker's Comp., but it may be too late now. In NY, you must file for comp benefits within two years. But, I suppose it's possible that could be extended if it is determined that you did not know the condition was from the work. See a worker's comp lawyer in your area. If the first one doesn't give you the answer you want, try another, maybe you will do better.

Sure, but you'll need an expert to determine why the airbags didn't deploy and the reason will have to be some fault of the air bag manufacturer, the sensor manufacturer or the vehicle manufacturer. Of course, such a case is expensive to pursue and unless your injuries are significant, it will be hard for any lawyer to economically take the case.
