Can I sue a law firm who I hired November 2011 because in May 2013 they sent me a letter saying they don't have the resources to continue my case?

More than likely not. If the firm has advised you of the statute of limitations and advised that they can not handle the case, Michigan law usually finds such actions reasonable and suggests that you retain new counsel before the statute runs out. Although Michigan judges, courts and legislators don't seem receptive to making it easier for people to sue, it could be that if you can document all your efforts to retain new counsel, and that every one you try to hire refuses to take the case solely because of the "lateness" of same, that you could perhaps convince a court that your ability to pursue a viable case was taken away by the firm that "sat on your case" for 1.5 years in that they didn't turn your case down in enough time for you to obtain counsel (although I think such a claim would be a long shot, so it's best for you to continue your efforts to find counsel and let them know of the closely approaching s/l). Of course, none of this takes into account whether you actually have a viable underlying case as you give no facts about the type of case, the liability, the damages, etc. It could be that your case has "problems" and this is why it is difficult to find new counsel vs. the timing of the statute?

You should not attempt to negotiate with the insurance company without legal representation to ensure the settlement you receive is fair. While it is true you may have to reimburse the State for the medical expenses paid, this comes out of the medical expenses portion of your settlement and can sometimes be negotiated down to a lesser amount, depending upon the circumstances. It should not affect the compensation for your bodily injuries and other harms you have suffered as a result of the accident. You should contact a personal injury attorney as soon as possible to discuss the options available to you.
