You can, but does he have anything to take? And do you want all of this to come up in court where everybody in the world will know of it? Are you trying to recover damages from him or humiliate him? Let's assume he is rich, you humiliate him and you get a bunch of money. (Oh, and it may take a year or two, depending on your court system, to finalize the trial. Add on a couple of more years for the appeals.) Or do you want to get him out of your life and become a somewhat normal human being? I suggest you talk with your therapist (if you don't have one, get one) and figure out whether the case would be good for you in the long run. If you don't want to do that, then contact a local attorney and see if he or she would be willing to take the case on. It could be expensive, even on a contingency basis.

It is not really your employer's call b/c if you file a worker's compensatiob claim it is the w/c carrier that decides what they are going to pay or not pay. Ask your employer for info on w/c carrier and contact them regarding not only compensation for injury, but also lost wages.
