Turn the matter over to your insurance company and give them her information. You may want to also consult an attorney. If the collision was not your fault or its one of those where the parties are both negligent, you can make a claim under your Uninsured Motorist Coverage in your insurance policy.

Theoretically possible, but unlikely to actually happen: The claimant's lawyers are interested in insurance company money.If there isn't enough coverage, they could go after your father personally but it would probably not be worth their effort to do so. Also: are you sure he owns 1/3 of your home? He might only have signed as a guarantor on the loan and he doesn't have to be on the deed to do that.

In New York, the statute of limitations is three years, so you have until April 16 2013. From what you describe, it is not a great case. It is ostensibly viable, but there are problems as well.
