Restaurants will generally pay any related medical bills - unless her dentist says she has or will have major problems you will probably have difficulty finding an attorney willing to pursue this. Only after she is sure she will not have any long term problems they will probably settle for some low number to get a full release.

What is a broken metacarpal pinkey worth in florida

default-avatar
Answered by attorney Charles D. Scott (Unclaimed Profile)
Personal Injury lawyer at The Law Offices of Charles D. Scott PLLC
First a little discussion about your condition. Simple fracture of the metacarpal bone takes about 6-8 weeks to heel. That assuming the bone is not out place, or have any complication factors. Spiral fractures are due to twisting injury to this bone, and typically heals in 3 weeks. It needs surgical fixation sometimes if it is displaced or angulated. A callus normally forms at the site of a bone fracture and it normally takes a number of months for it to return to normal through remodeling. Most fractures need 6 weeks to heal before you can really use them. Based upon the foregoing,  you will most likely heal, hopefully with no complications by 6 weeks. if you heal just fine with no complications and regain full use of your pinky, then your case may have a value in the range of $5000 to $15,000. Keep in mind this is a rough guess based upon prior cases of this nature. Every case is different and yours may have certain factors that make it worth more. For example someone who played the piano for a living might have a larger claim value if their pinky was broken. The value of your claim may also be limited by how much insurance is available to cover your injury.  You did not state how your broken pinky came about, for example was it the result of a car accident? slip and fall? an assault and battery?.  Depending on how you were injured, a lawyer must then determine if there is insurance coverage such as auto insurance, homeowners insurance, etc.  Then the value may be limited by the limits of coverage available. For example if there is $20,000 in liability coverage, then your claim may be limited to the available coverage.

How can I get a settlement for a car accident if I can't prove that it was the other party's fault?

default-avatar
Answered by attorney Robert Morrison Lucky (Unclaimed Profile)
Personal Injury lawyer at The Lucky Law Firm, PLC
In the situation you described, it is very difficult to prove that the other person was at-fault and that you were not. A disinterested witness is often very important to a liability decision in such a "he said/she said" situation. You may be able to get the other insurance company to accept up to 50% of the liability, but beyond that will be difficult. Consult with your insurance company and see if they can obtain the surveillance video at the intersection.
