This sounds more like a riddle than a question. Are you using the term "brother" in the genealogical sense, or the colloquial sense? Brother of whom? The doctor? The patient? The son? Who is it that cannot be found? The patient? The son? The brother? Who is it that died? This site allows you to submit "question detail" try re-posting with a narrative and describe what happened.

Do I have a malpractice case if it has been 14 months after the surgery and my daughter still has problems walking and lost feeling in her foot?

I am extremely sorry this has happened to your poor daughter. In California, the medical malpractice statute runs from 3 years from the date of the accident, or 1 year from the date of discovery, whichever is earliest. I would strongly encourage you to contact a med mal lawyer right away.

Do I have a case for slipping and falling and fracturing femur in hotel room with hardwood floors?

Answered by attorney John F Turck (Unclaimed Profile)
Personal Injury lawyer at Blaske and Blaske PLC
if this happened in Michigan, no Nothing defective or dangerous about the floor, and you decided to walk around in your socks if you decide to pursue it further, be advised that you have 3 years from the date of the fall to file a lawsuit, otherwise your lawsuit will be time-barred.
