Aprox time line on mcdonald lawsuit

Answered by attorney Jonathan Howell
Personal Injury lawyer at Czech & Howell, APC
Hi Mary, When did you fall? What are your injuries? Most of these cases settle within a few months after the injured party has completed their medical treatment. When a settlement cannot be reached a lawsuit must be filed within two years from the date of the accident. Are you working with an attorney? Thanks,Jon

Are we liable for physical damage to a friend's car?

Troubled parent: No, generally the parent of a minor is not responsible for the negligent actions of their minors, however, there are exceptions. If the minor is on an errand, employed by or agent of the parent than vicarious liability can attach. If the parent has signed for the driving permit, they can be liable up to $15,000. If the minor's conduct is willful that can assessed against a custodial parent. If a parent knew or had reason to know that the child was going to engage in negligent conduct, for example child had taken car without permission on prior occasions, than liability to the parent could be assessed. It sounds like none of the exceptions apply and therefore while your child is responsible, legally you are not. That is really the purpose of insurance and not sure why your friend doesn't want to submit it to their insurance carrier other than they may have a myriad of recent insurance claims and don't want the adverse consequences on their insurance rates.

Place a mechanics lien on the property/person. Get a judgment and execute on it. You'll need an attorney's help. Look for a debtor/creditor attorney.
