Odds are with a prior DWI that she has only minimum policy limits so you would end up having to file a claim on your own underinsured policy (if you have that coverage). Short answer is YES, you need a lawyer and you need to file with victims assistance as well and make sure that you are listed as a victim so that the DA has to contact you before any deals.
