You do not have to accept the offer that is being made. If necessary, you could file a case in small claims court. As a general rule, a liability insurance company does not have to pay more than the value the car had immediately before the accident. I assume the town is claiming that the value of your car immediately before the accident was $1,985. If the town can prove it is right, you will probably not get more than that.

You need to explain what "a $2000 difference" means. If your insurance company paid the other car's owner for the damage to his car, there may be a settlement agreement that states that whatever they paid is the TOTAL amount of the settlement, in which case the matter is closed and the other car's owner cannot come after you. In theory, your insurance company should have done this, HOWEVER, if the insurance company informed you, for example, that the damages to the car were in the amount of $7,000, but you only had $5,000 in insurance coverage, and the insurer is paying their limit but you are still liable for the difference, then you will have to pay the difference out of your own pocket. You should see an attorney about this as soon as possible.

She could file suit against him, but under the circumstances, It will be hard for her to prove her case. Since the lady did not cooperate with the officer, you should notify your insurance company of the possible claim, and let them handle the matter so that your husband is not talking with the lady directly. If he talks with an attorney, the likelihood of an attorney taking her case is slim.
