From what you've described it does not sound like you can.  In New York State, you cannot sue your employer for personal injuries sustained on the job unless you've sustained a "Grave Injury".  A Grave Injury is limited to inuries such as death, loss / amputation of multiple fingers, paraplegia, severe facial disfigurement, etc.  You can, however, file a claim for workers' compensation benefits (assuming your employer carries workers' compensation insurance).

What were the father's actions? Is he safely tucked away in prison for the foreseeable future? Write a letter to the attorney asking for the retainer back, or an itemized statement or you will be forced to contact the State Bar. Set a 10 day deadline, then complain.

Be polite but persistent. Call the nurse again. Go on what you know, not what you think maybe. You know that your children need medical attention. If you can't get in to this pediatrician, then see if there is some outpatient clinic you can go to.
