Hi Joan, It is "no fault" because the law in New York provides that if you’re a passenger in a car (or in your case hurt by the car you are trying to enter) the driver's insurance pays your medical bills and other costs no matter whose fault the accident is.  That does not mean you have to take the settlement that is being offered by no fault.  If you will not be adequately compensated by the settlement they are offering, you can sue the driver or have an attorney try to negotiate a better settlement.  Feel free to call my associate Michael Dombrowski at (516) 812-4566 to discuss whether the settlement being offered is reasonable based upon your injuries. I don't think it would work. While there is clear negligence, the damages can be described as "remote and consequential" that is, beyond the scope of what could be controlled or anticipated. Feel free to see if you can find an attorney who would be willing to take on the case, but if you can't, that's probably the reason.
