Is there any action that we should take after my husband slipped and fell in FL?

default-avatar
Answered by attorney Angelo Marino (Unclaimed Profile)
Personal Injury lawyer at Angelo "Tony" Marino, Jr., P.A.
Just because your husband slipped and fell does not in and of itself impose a duty on anyone. You and your husband will need to see a lawyer who handles these types of cases to determine if anyone is responsible for your husband's injuries.

What can I do if I have a felony because of a missed court date but I have turned myself in?

James Peirce Kelaher
Answered by attorney James Peirce Kelaher (Unclaimed Profile)
Personal Injury lawyer at Kelaher Law Offices, P.A.
First thing you need to do is check with local law enforcement to find out if you really have a felony on your record. I can't imagine a judge would convict you of a felony for missing a court date and then turning yourself in later. If for whatever reason you have a felony on your record, you need to come up with the money to hire an attorney to expunge your record....as having a felony on your record will ruin your life, and probably ruin your chances of enlisting in the service.

Does an attorney have a right to place some of your settlement funds in esrow for medical bills that were not paid by the insurance company,?

Answered by attorney Eli Kaplan
Personal Injury lawyer at Kaplan & Miller, P.A.
If an attorney receives money in trust, he has an ethical obligation to protect the claims of third parties who may have a valid interest in those funds.  When you settled, he received money in compensation of your claims which included medical expenses not covered by PIP.   This is not to say he has to hold the money in perpetuity.  At some point, he needs to be proactive in requiring the third party (your radiologist) to take reasonable action to collect the money.  The fact your lawyer didn't sign a letter of protection doesn't release him from an ethical and legal obligation.  From what you describe, it seems that a letter from the radiologist to the lawyer allowing him to release his escrow to you should be enough.  You can call the Florida Bar in Tallahassee and speak to a staff ethics lawyer.  They probably have an advisory opinion for situations like this.
