Typically future medical payments are to cover future treatment for a current injury. As such, receiving payment for future treatment will not prevent a claim for a subsequent injury. Your prior injury will likely be taken into account when determining what injuries you already had (I.e. per existing) and what injuries are from the new injury. As you have not been compensated for your recent injury, I would recommend consulting with a workers compensation lawyer regarding the injury and the current working conditions.

There are a lot of facts that are not filled in here. However, provided everything else checks out, it would appear that your wife sustained damages and injuries due to the negligence of the store and therefore she would be entitled to recovery of some sort of damages. It would be wise to discuss this matter with an attorney in your area as it appears that you definitely need legal assistance.

For example, if you ever leave the child alone while you take a shower, then it will be difficult for you to say it is negligent that your sister did this. If your son requires constant supervision so that he can never be left alone, then her actions might be considered negligent. Her actions after the accident are irrelevant, unless her failure to get immediate medical care caused the bills to be higher. Another question in deciding whether to sue is whether your sister has insurance (such as homeowners) to cover this, or if she doesn't, does she have assets to pay a judgment. If she does not own a home it will be difficult to collect any judgment (it is difficult to collect from personal property such as cars, etc.) If she does have homeowners insurance, it might be worthwhile to file a claim. Some homeowners policies pay for medical bills regardless of fault.
