If you have hired an attorney to pursue the case for you, the best thing to do is to discuss this with your attorney.  At taking your case, you should have entered into a written fee agreement that should explain what fees or costs you are responsible for and when.  Unfortunately, I can't provide an answer since I don't know the agreement, but you should be able to clear that up with a quick phone call to your attorney.  If you haven't hired an attorney and are just interested in whether it is possible to enter an agreement where the attorney fronts the costs for things like obtaining records, sure, it's possible - you just need to make sure you understand the fee agreement so you know exactly what fees and costs you'll be responsible for and when.

You will have to sue the driver, but you might be able to sue the policy holder/owner of the vehicle if you can show some sort of negligent entrustment. You should consult a personal injury attorney in your area.

Nothing good, it will go up probably daily, I got one in San Fran years ago for expired meter on a rental car,my wife tore it up without telling me. By the time Hertz got it to me it was $250 instead of $10. states have reciprocity with other states for just this.
