Can I file a lawsuit against a shipping company by letting someone sign for my package?

Answered by attorney Andrew Tyler Velonis (Unclaimed Profile)
Personal Injury lawyer at Andrew T. Velonis, P.C.
I have a feeling that the shipping company has some way of having themselves protected from situations like this. Did the company that you bought the items from offer you different shipping options, and was restricted delivery one of those options? Did you click on "I agree to terms" and thereby agree to have them ship your purchase without restricted delivery? Was there insurance? Was insurance an option? Contact both the seller and the shipper and tell them of your plight and see what they will do to help you out. Good luck.

Can I sue because my daughter was wrongly diagnosed in the ER?

In order to prove a medical malpractice case, a claimant must prove a failure to conform to accepted practice, resulting in an injury. A bad result is not enough, and if it is a "judgment call" by the doctor, there is no malpractice, even if the doctor made the wrong call.

Is there a way to protect me from being liable in case our dog bites our neighbor?

James Peirce Kelaher
Answered by attorney James Peirce Kelaher (Unclaimed Profile)
Personal Injury lawyer at Kelaher Law Offices, P.A.
In Florida, there is a statute that says if you own a dog, and your dog bites someone, you're responsible. However, if you post signs in conspicuous places that say, "WARNING - BAD DOG" then that can be used as a defense. If the kids are too young to read, then send letters to their parents, warning them about your dog and that their kids are TRESPASSING on your property. The only duty you owe a trespasser is not to intentionally harm them.
