The insurance people call this "med-pay". It is not required, but if they have that coverage, they will pay for medical expenses. Yes, you can sue for damage to your car. The fact that the guy was drunk really doesn't have any relevance. He hit your car, he is responsible for the damages, whether he was drunk or not.
