You should write to the attorney, sending your letter certified mail with return receipt requested, include a copy of the settlement agreement, explain you are now 18 and entitled to the settlement, and that you now wish to receive the settlement. If the lawyer does not respond, write again, certified with receipt, explain the situation again. If this does not prompt a response, contact the Board of Bar Overseers with copies of the above documentation and proofs of delivery to file a complaint. You should then retain counsel. You may sue the attorney within three years of the date of the event giving rise to your suit (the failure to pay your settlement to you).

If the doctor is in California and you were going to see him there, your claim will have to be brought in California, and you will need a California attorney. The statute of limitations in California is 3 years from the date of malpractice or 1 year from the date it was discovered, whichever is sooner. In your case, it can be argued that the malpractice was continuous, throughout the last time you went to see that doctor; but the shorter, 1-year from discovery, term will govern. Since preparation of these cases takes a lot of work and a lot of time, don't delay looking for a California attorney. (By the way, it does not necessarily mean that an attorney for your case can be found only in California; there are New York medical malpractice firms that have attorneys who are admitted in California and practice there).

The manufacturer and seller of a product can be held liable for injuries caused by a defect of the product. You would have to prove that the foreign object was in the food and that is what caused your child to choke on it. Unfortunately, there are scam artists out there who try to make such claims and it is difficult to tell the genuine victims from the scammers. Unless there was a severe injury, it may not be worth pursuing.
