A notice of claim needs to be served on the school district within 90 days of the incident. If this is a private school you have three years from the date of the incident to sue for negligent supervision and personal injury.

Without commenting on whether you have a case, which you do not ask about, to file or start a personal injury case you file a "Complaint" or a "Plaintiff's Claim And Notice To Defendant" if filing in Small Claims Court and pay the filing fee. The filing fee for Small Claims, County and District court is different. In Small Claims Court the most you can collect from another person is $3,500.00. The Nebraska Supreme Court has a "Plaintiff's Claim And Notice To Defendant" you can fill out. As noted, in County or District court you must file a "Complaint." In general, the complaint must contain information about what happened, who you are suing and what you want. It must have a caption and be signed. It would be too difficult to try and explain everything that must be in a complaint. The next step is having the defendant, the person you are suing, served with a copy of the complaint and a summons. After that, many different things can occur before you go to trial. You may want to consult with a personal injury attorney. Most offer a free initial consultation so it will not cost you anything to learn about your rights and options.
