In order to prove a medical malpractice case, a claimant must prove a failure to conform to accepted practice, resulting in an injury. Expert testimony from a physician is required. These cases are difficult and expensive to prove and they do not settle out of court. The insurance company is correct, fixing it now would be cosmetic only. The case you describe, even if successful, would not be economically feasible. You are better off saving up some money to get it done right.

Generally any unintentional injury that is caused during your employment is limited by workers comp. if the act was premeditated and deliberate then you can make a serious and willful claim and even a personal injury claim. The threshold for such claims are high and one will have to analyze all circumstances surrounding the incident to make such a conclusion. Also you need to consider statute of limitation issues.
