Question is how did the critical piece become out of place? Two possible answers: 1. It was manufactured improperly, with the key piece out of place. In this case the manufacturerwould be strictly liable for manufacturing a defective product. However the installer could also share some fault if the defect was obvious and should have beed detected and repaired or replaced during installation. 2. The second possibility is that the misplaced piece was caused by negligent installation, in which case the installer would be at fault. However, the manufacturerwould have to prove that the misplaced piece was correctly in place when the door left the Manufacturer.

You definitely should hire a lawyer to help you with both the underlying claim by the child as well as with your insurance company. I think that they are probably on pretty shaky ground denying the claim even if the policy calls for you to report the incident within 72 hours. Thanks,Jon

What are my options if I got broken finger at work and it healed misaligned, company doctor says no to surgery?

You can try to get your employer (or its insurance carrier) to follow the advice of the "specialist" so you can have surgery to try and regain further motion in your finger. If the employer or insurer will not agree to it, you, assuming you want the surgery, would need to file a petition in the Nebraska Workers' Compensation Court and get a judge to agree that you should have surgery. You may want to talk to a workers' compensation attorney about your case. Most offer a free consultation so it would not cost you anything to learn more about your rights and options.
