Is this medical malpractice or misdiagnosis? Shouldn't they have listened and did a simple x-ray at least?

Sounds like "I don't care" type service but whether it is malpractice is a medical question not a legal one.

On the facts you listed, it appears you do have a claim for medical malpractice. It is likely that you will want to sue both the doctor and the hospital. If it is a municipal hospital, a notice of claim has to be filed within 90 days from the date of the malpractice.
