The quick answer is no. The owner of the van has no liability, the fault lies solely with the hit and run driver. Without comprehensive/collision coverage or uninsured motorist coverage, your own insurance company cannot help you.

I counsel a more conservative analysis. You appear to have two separate biting incidents and thus there is an issue of comparative fault. I'd think that after one tooth was damaged, you would have cleared your mouth. Aside from your braces (which I used to wear) the incisor and molar repairs (which I have had) are ordinary ones; there is lack of evidence of need for a root canal. It's hard to believe that your orthodontic care and veneer are much delayed but having to live with a chipped veneer incisor would aggravate damages albeit reduced somewhat by the unsightliness of braces.

I'd have to see the records, investigate further and get an expert opinion from an OB-GYN to actually answer the question. But from what you describe, this sounds like a "judgment call" type of situation; the doc made the best decision he could based on the information he had at the time. Even though he turned out to be wrong, that in and of itself is not malpractice. You would have to prove that the dr. failed to conform to accepted standards of practice. I'm concerned about the long-term effects of the medication, though. If there are severe consequences, you might want to have the malpractice question investigated. Statute of limitations in NY is 30 months.
