Does the other drivers insurance company have the right to request my medical records?

Answered by attorney Steven Alan Fink (Unclaimed Profile)
Personal Injury lawyer at Fink & Abraham LLP
Standard operating procedure to request records. They can only be used for purposes of this claim. If you file suit against the driver of the other car they can subpoena the records as a matter of law. If you do not file suit you do not have to release the records but they do not have to pay your bills. In that case the ambulance, hospital and doctors will hold you personally responsible. I would release the records.

Is a general release of claims a legal binding document if notarized and signed by attorney?

Paul L. Whitfield
Answered by attorney Paul L. Whitfield (Unclaimed Profile)
Personal Injury lawyer at Paul Whitfield and Associates P.A.
A release should be signed by the person not injured, not by her attorney (unless he has a power of atty)a release that is properly executed is binding. Are you sure you have properly documents? Sounds like you do not.

Can I sue the dentist because he did not give me antibiotics before the extraction?

Answered by attorney Andrew Tyler Velonis (Unclaimed Profile)
Personal Injury lawyer at Andrew T. Velonis, P.C.
Dental/medical malpractice cases are always difficult to prove, as well as expensive and time consuming. Extractions necessarily include a possibility of complications, including infection or damage to surrounding tissues, so it is possible that some of the injuries were unavoidable. Since he said it was rare that the infection would spread, that sounds like a judgment call which is outside the scope of malpractice. It is possible there may have been a failure to adhere to accepted practice, and resulting injury as well, but in order to be able to pursue it, you would need expert witness testimony.
