Is it wise to talk to the insurance company who is calling me?

Paul L. Whitfield
Answered by attorney Paul L. Whitfield (Unclaimed Profile)
Personal Injury lawyer at Paul Whitfield and Associates P.A.
Many businesses have medical payments insurance which pays medical bills for any incident on the premises. Has nothing to do with fault. If you slipped on a menu I don't see that as fault so liability is not likely a question.

How much of a personal injury settlement will I be entitled to?

default-avatar
Answered by attorney Brian Joseph Bourke (Unclaimed Profile)
Personal Injury lawyer at Gilbert & Bourke
That is not necessarily true. You would need that issue spelled out in the retainer agreement you sign that the fee is based only on sums over that amount you negotiated. Generally, the retainer agreement, unless modified as above, would base the fee on the total gross settlement. You would want to make sure any prospective attorney you hire would agree to modify the retainer agreement.

Can we still file a personal injury claim even though she is now an adult? How?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
Personal Injury lawyer at Richard B. Jacobson Associates, LLC
As an adult, she can make the decision whether or not to pursue a legal action. How come you did not make that decision for her when she was still a minor? Please note that the limitations period within which you must bring an action, if at all, is three years from the date of the other's party's negligence. Find a good personal injury lawyer. Good Luck.
