Can my attorney agree on a settlement without my consent, and then threaten to quit if I want to proceed to trial?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
Personal Injury lawyer at Richard B. Jacobson Associates, LLC
The decision to accept or reject a settlement is solely the decision of the client. However, if a client persists in doing something which the lawyer thinks is illegal or imprudent, the lawyer may withdraw. (If the matter is before a court or other tribunal, he needs the permission of the judge or tribunal.)

Can I sue the owner of the property?

default-avatar
Answered by attorney Brett Edward Rosenthal (Unclaimed Profile)
Personal Injury lawyer at Graves Law Offices
File a worker's compensation claim number one, and depending on the nature of the condition, you may be able to sue the property owner. The condition must be such that you can characterize it as "dangerous" which of course is very subjective, which would include the anticipation of foot traffic in the area, depth and length of the hole, visibility of the hole. If it is "open and obvious" that is also a defense to such a claim.

There is a two year statute of limitations from when you turned 18 with some exceptions that do not appear applicable. Sorry but your claim is too late
