Can my car insurance policy, can they legally change the policy on me?

David F. Stoddard
Answered by attorney David F. Stoddard (Unclaimed Profile)
Personal Injury lawyer at The David F. Stoddard Law Firm
Yes, especially when the policy is renewed, which is usually every year. Whether they can change it in the middle of a policy period depends on the language contained in the policy. For example, many policies probably contain provisions allowing them to raise your rate during the policy period if you are convicted of a traffic violation.

Is her claim for pain and continued suffering really valid after filing it four years after the accident?

The statute of limitations in Michigan on a third-party automobile accident claim (which sounds like the lawsuit you describe) is three years, not four years. But to answer your question, her claim for continued pain and suffering might be valid - I certainly have clients who continue to suffer for many years after a crash - but it all depends on whether she had preexisting conditions and what happened in the crash, i.e. what injuries she suffered. But if this is a Michigan case, based on what you describe it sounds to me like she filed the case well past the statute of limitations. In any event, if you have not turned this matter over to your insurance carrier - the one you had in effect at the time of the crash - you should do so immediately so you don't run any further risk of voiding coverage for not having turned the matter over to the carrier promptly.

Can a doctor that treated me after I fell at my job call my job and ask if I’m getting abused at home because my bruise looked so bad due to my fall?

Absolutely, a doctor, or anyone else, may ask you any questions they wish. You do not necessarily have to enter them. In this case, if it was your personal physician who asked the question it is most probably because they wanted to help you. If, on the other hand, the physician was the company's doctor it is possible that he was trying to determine whether or not your ranger he was actually work related.
