Usually an employee is limited to worker's compensation when pursuing claims for work-related injuries against their employer. A tort (personal injury) claim can generally only be pursued if the employer's actions were such that he knew or should have known you would have gotten injured. Examples would be if he intentionally hurt you or if he knew your truck was leaking carbon monoxide into the cab and that it was likely to make you sick.

Not sure I understand your question. You can sue the folks if you can prove your case. You stated a lot of damages you probably cant prove. You will have to hire experts to testify. Your own ideas wont carry any weight.
