The unpaid portion of a Judgment draws simple interest @ 10% per year. Your only way to avoid it is to work out a deal with the judgment creditor and that is usually done by paying it off at less than full value no some payment plan.

Your insurance carrier will be entitled to be paid back from whatever proceeds your receive. Unless, the injury is significant, it probably wont be worth pursuing. Nevertheless, you should contact a local attorney to discuss the possibilities.

When you say that "my workers' compensation is filling [sic] for bankruptcy" I am presuming that the insurance carrier is filing for bankruptcy and not the employer. If the carrier is filing for bankruptcy, the State of California has the "California Insurance Guarantee Association" (CIGA) which will take over the adjusting of the claim and thus your right will not utlimately be affected too much. CIGA will not be responsible for penalties incurred by the carrier. This is the only difference. There may be a delay in transferring of the file from the private carrier to a CIGA adjustor though.
