Often, all you can recover is the amount of insurance coverage. You can get a judgment against the at fault driver for the rest, but if she does not own any real estate, stocks or large bank accounts, it will be very difficult to ever collect the judgment. Plus, she can file bankruptcy and get it discharged. 25,000/50,000 means she has only 25,000 coverage for each injury, and with a cap of 50,000.00 if more than one person is injured. Thus, her insurance will pay only $25,000.00. If you have underinsured coverage, which most people don't, it will cover you up to your liability policy limits, which are 100,000/300,000. Thus you can get only 100,000 from your underinsured coverage, if you have it (300,000 is if more than one person is injured). If you don't have underinsured coverage, you can get only $25,000.00. If you are in SC and don't have underinsured coverage, you should ask your insurer for a copy of the document you signed waiving such coverage. They are supposed to get you waiver of underinsured coverage in writing.
