Do your/your brother have a detailed statement from his insurance company why they won't pay the claim? Get that. Be sure his insurance co. is presented with the claims arising from the collision. Be sure the other insurance company (and also their insured who wants $1,300) has the information concerning your brother's policy. Send all this information to everyone by certified mail so you get proof they have received it. Write a detailed coherent statement of the facts. Look up California Department of Insurance via google and find out where to file a complaint. Send a copy of the brother's insurance policy and all correspondence to the Insurance Department. You were driving the vehicle with your brother's permission. Put pressure on his insurance company.

You can if you can prove it was malpractice. You have to hire a doctor to review all the medical records and tell you if it is or is not, and then agree to restify for you. Is it worth the time trouble and money?

It depends on the nature of the deposition. If you are a party to the action you have to show up. If you are a designated expert witness, you can demand your expert witness fee prior to the commencement of the deposition and your first hour of fee must be paid prior to commencement of the deposition. If you were my expert on behalf of a plaintiff I would negotiate to take the deposition at your office so that you do not have any down time. If are a retained expert you must contact the lawyer that retained you to sort out these issues for you.
