It would be helpful to know why you are being sued. If the amount won is in excess of the policy limits, you can be held liable for that excess. Insurance companies also do not pay for intentional wrongs, only negligence.

The way I read it, the problem lies with the surgeon who operated on you 3 years ago. You said that two doctors said that it was a sloppy job, that bone spurs had not been removed and that is what is pinching your spinal cord. So if it was the surgery that was done incorrectly, that would be the focus of the inquiry. Unfortunately, in NY, the statute of limitations for malpractice is 30 months, so you would be too late. As far as the doctor who failed to diagnose the problems stemming from the surgery, it would appear that you would have the same problems that you now have even if he had done all the tests and made the findings you refer to. (But if it's the same specialist who did the surgery, that could extend the statute of limitations). Finally, from what you have written, it would appear that "chronic neck pain" would indeed be a correct diagnosis.

There may be a product liability case against the mesh manufacturer. There have been recalls of medical mesh products the last few years. Your medical records should show the exact manufacturer and model of the mesh used in your surgery. Once you have that information you should be able to determine if the mesh in your body is one of the mesh products that has been recalled. Even if it has not been recalled yet there are legal steps (including possible litigation) that can be taken on your behalf. You really need to get an attorney experienced in product liability cases involved with this. There are statute of limitations issues here so you must move quickly.
