Could I be sued for legal fees if I lose personal injury lawsuit?

Answered by attorney Brett Edward Rosenthal (Unclaimed Profile)
Personal Injury lawyer at Graves Law Offices
No. California is a no attorney's fees state in the event you file and lose a personal injury lawsuit. However, while you may not be responsible for the other sides fees, if you lose you could be responsible for the other sides costs, which include filing fees, deposition costs, records acquisition fees, jury fees, etc. In addition, the other side can make a statutory offer, called 998, which is reference to specific Code of Civil Procedure. In the event such an offer is made and you do not accept it and don't do as well at trial you can also owe the costs of expert witnesses, which can get very large if they bring liability and medical experts. Make sure have a good case is you are going to file.

Is it considered a malpractice if the dentist pulled out the wrong tooth?

Thomas C. Bulman
Answered by attorney Thomas C. Bulman (Unclaimed Profile)
Personal Injury lawyer at Bulman Law Associates PLLC
One tooth does not a lawsuit make. You need dental insurance. Find an employer that offers health insurance, with dental. Wait for the qualification period to expire then get more dental work and max out each year with cleaning, xrays, 6 month exams, whitening, etc.
