If one law firm turns down a case does that mean you have no case?

I am not licensed in New York, but in New Jersey if a worker is injured in the course of his employment then he or she is entitled to workers compensation.  This is true even if the worker tripped over his or her own shoelace.  In other words in a workers compensation case Petitioner's attorney does not have to prove that the employer did something to cause the worker's injury. However, to pursue a case against a third party...say the owner of the property where the puddle existed, Plaintiff (the injured party) would have to prove that the owner was negligent in that said owner negligently created or failed to address a dangerous condition which the owner knew about or should have learned about by reasonable inspection.  A pre-requisite to recovery against a third party in NJ requires proof that the third party was at least 50% negligent.  These cases are very fact sensitivw.  From your description of the incident I suspect that counsel did not believe the case would present well from a liability standpoint, becuase your shoulder surgery, if liabilty against the could be established, would certainly produce a worthwhile financial outcome. I would suggest that you seek another opinion of your third party case from other counsel who may view the case more favorably than the attorney you initially consulted.  Best of luck to you. In California, personal injury settlements (and awards) are considered (a) community property if the cause of action arose during marriage, or (b) separate property if the cause of action arose after permanent separation (or before marriage). (NOTE: The injured spouse must reimburse the community (or the other spouse's separate estate, if used) for any expenses paid on account of the injury.) In your case, (a) applies. However, California law further holds that, at divorce, community property awards and settlements are assigned entirely to the injured spouse, so long as (1) the funds from the award/settlement have not been commingled with other community property funds, and (2) the interests of justice do not require otherwise.

Someone can always sue, that's not the issue, the issue is whether or not you can win that lawsuit.  Your case seems to be something that might be very difficult to prove, and is not a "sure thing".  Because of that, it might be difficult to find an attorney willing to undertake all of the time (and expense) of bringing the lawsuit on a contingency fee basis.  If you are willing to pay an hourly fee, then a lawyer might accept the case.   There are many factual issues:  Did you ever complain about shoulder pain while pitching?  Did anyone at the school ever tell you to keep pitching? Did a coach or trainer ever say to you don't worry about how much you pitch it won't bother you?  Did you ever complain about pain?   It seems like you might have many proof issues if you pitched softball for three years, did not complain about the pain while pitching, and then a year after you stopped, you were told you have a problem with your shoulder caused by the pitching.  You have 90 days to alert the school from the time you knew, or should have known about the problem. If you are within 90 days of being told your shoulder is injured, you can still file.  Good luck.
